Minutes of the Public Hearing of the Town Board of Cincinnatus held April 7, 2022 at the town hall commencing at 7:00  PM for the discussion of Grievance Night.

Call To Order; the public hearing was called to order at 7:00 pm by Supervisor King.


Caitlyn Brown, town assessor explained the need to change the night of the grievance hearing night due to the number of towns she currently serves as an assessor.

The date this year will be June 1, 2022 from 4:00 – 8:00 here at the town hall.

Appointments will be required.

The Grievance process will be as follows:

Letters of assessment change will be mailed out by May 1, 2022.  If you disagree with your assessment then you must contact Caitlyn to set up an appointment to discuss with her at one of the following times and locations:

Homer – 5/9  9am – 1pm; 5/16  9am – 1pm; 5/21  2pm – 6pm; 5/23  9am – 1pm

Cincinnatus – 5/17 2pm – 6pm

You will need to bring documentation, photos, etc to present your case against the assessment.  Caitlyn will work with you to try and resolve and come to a mutual agreement prior to needing to go to the grievance hearing.

If an agreement cannot be made then you will need to bring all your info and present your case to the assessment review board on grievance night.  The board will listen to all grievances and then make decisions after the hearing night is over.  You will receive their decision via mail.


Phillip Hegedus voiced concerns about communication and being given incorrect information.

  1. Call To Order; the meeting was called to order at 7:17 pm by Supervisor King.

  2. Approve the meeting  minutes of 3/10/22.  

A motion to approve the 3/10/22 meeting minutes was made by Mark Christian, seconded by Steve Mudge.

Ayes: 4 Nays: 0 motion carried


  1. Financial Report – Town Clerk, Water Clerk, County Treasurer and Justice (all attached)

A motion was made to accept the financial reports by Mike Stafford, seconded by Steve Mudge.

Reports: – Departments and Sub-Board:

Planning – Jason let the Board know that planning has completed going through the solar laws and will have proposed changes at the next Town Board meeting.  The Planning Board wants the townspeople to know they want to work with them and are open to any and all communication.  Time Berrup has been helpful to the Planning Board and has much knowledge and insight.  It is believed that there are many people in the Town of Cincinnatus doing things without acquiring the proper permits.


Highway Allie’s work schedule is attached.  They are beginning to transition to summer tires, etc for the trucks.  Next week street sweeping will begin, one that is completed they will begin work on pot holes.  There is training at Solon Sportsmen’s Club next Tuesday that both Allie & Derek will be attending.

Supervisor King noted that she received a formal thank you note from the Cincinnatus Fire Police thanking Allie and his department for an incident they assisted with in March.

Wayne Landers asked Allie about curb replacement, Allie stated that is the county and he will inquire.  Phillip Hegedus expressed concern over the water pooling up near the culvert of on Route 41 near Knickerbocker Road, Allie will look at that after the meeting.  David Steiginga inquired if there would be a town Amnesty Day, Supervisor King said the Board needs to finish the planning of that.


Water DistrictTyler – report attached, Tyler states that the road to the water tower is not currently passable.

Phillip Hegedus explains that he wants to communicate with the Town’s lawyer due to the fact that he was not allowed to join the planning board and the town wouldn’t hire him as the code officer.  Supervisor King explains that he can have his lawyer communicate with our lawyer.  Mr. Hegedus states that he should communicate with our lawyer, as he is a resident of Cincinnatus the town’s lawyer also works for him.  The Board asked Mr. Hegedus if he resides in Cincinnatus all seven days a week, he states that yes he does.  Let it be noted that Mr. Hegedus’ tax bill for his property in Cincinnatus is mailed to an address in Endicott, NY not the actual address of the property here in Cincinnatus.  This has been verified by the Town Clerk.


  1. Old Business: Website – The new Town website is up and running.  Should be fully completed in another month or two.


  1. New Business:  Approval of Local Law to move Grievance Date to June 1, 2022. 

A motion was made to approve Local Law #2 of 2022 by Michael Stafford, seconded by Steve Mudge.

A motion was made by Steve Mudge, seconded by Mark Christian to   approve warrants.  

Ayes: 4 Nays 0 motion carried


  1.  Board Work Shop Thursday April 14, 2022 7:00 pm – to discuss sidewalks and water.  This is for town board members only.

  2. Executive Session

A motion was made to move to executive session at 7:52 pm to discuss a personnel matter by Mike Stafford, seconded by Steve Mudge.

A motion was made to return to public session at 8:04 pm by Steve Mudge, seconded by Mike Stafford.

The Town Board will have a workshop next Thursday April 14, 2022 for Board members only.

The next Town Board meeting will be May 12, 2022 at 7:00 pm.
