Minutes of the regular meeting of the Town Board of Cincinnatus held June 9, 2022 at the town hall commencing at 7:00PM.

  1. Call To Order; the meeting was called to order at 7:00 pm by Supervisor King.



  1. Approve minutes of the town board meeting of 5/12/22.

A motion to approve the minutes of the town board meeting of 4/7/22 was made by Johnathon McKee, seconded by Steve Mudge. 

Ayes: 5 Nays: 0 motion carried


  1. Financial Report – Town Clerk, Water Clerk, County Treasurer, Justice

A motion was made to accept the financial reports by Michael Stafford, seconded by Johnathan McKee.  

Ayes: 5 Nays: 0 motion carried


  1.  Public Commentary 

Wayne Landers has concerns over the highway superintendent resignation.  He believes that the outgoing highway super was doing a good job.  The Board tells Mr. Landers that they cannot publicly comment on personnel matters.

Wayne Landers also asks where the rescue money is being spent, Supervisor King explains that it will be spent on the upcoming sidewalk project.

Phillip Hegedus comments on a letter he received from Tim Bearup, Code officer.  Mr. Hegedus states that his correct  mailing address is 2907 State Route 41 in Cincinnatus, although the tax rolls do not reflect that mailing address.  Mr. Hegedus wants to make the following point to the Town Board:

  • He does not have 5,000 square feet of tires on his property

  • He does not run a junk yard or a dump.

  • He believes her lives on a road maintained by the County and the town has no governance over him or his property.

  • He believes he is being singled out and wants the nonsense to stop.

Mr. Hegedus gets very loud and rude and is asked to quiet down or leave the meeting.

Planning Board Jason Tuning, Chair states that the Planning Board is working on updating the master plan.  Minutes from last planning board meeting are attached.


A motion was made to approve Local Law 3 of 2022, amending the Zoning Law of The Town of Cincinnatus for Solar Energy Systems by Michael Stafford, seconded by Johnathan McKee.

Beautification Committee – flags up, some plants done 

Dog Warden SPCA – report attached, respond to a call on Dutch Hill

Joint Youth70 kids signed up for baseball and T-ball.  Tyler Mudge asks about looking into a backstop for the park.

Town Attorney – Fran Casullo 


  1. Old Business: Sidewalk Bids were opened, 1 bid was received.

A motion was made to accept the bid from Davis Concrete Construction for the sidewalk project by Michael Stafford, seconded by Steve Mudge.



  1. New Business:  Retain outside counsel for a legal matter

A motion was made to retain outside counsel by Jonathon McKee, seconded by Mark Christian.

Ayes: 5 Nays: 0 motion carried

Insurance requested repairs have been done:  roof over fuel tank, furnace room insulation, judge and clerk doors secured.


A motion was made to move to Executive Session at 7:22 pm by Supervisor King, seconded by Michael Stafford. 

Ayes: 5 Nays: 0 motion carried


A motion was made to move back to regular session at 7:33 pm by Supervisor King, seconded by Mark Christian. 

Ayes: 5 Nays: 0 motion carried


A motion was made to accept the resignation of Allie Potter Jr by Steve Mudge, seconded by Michael Stafford. 

Ayes: 5 Nays: 0 motion carried




  1. Adjournment:

A motion was made by Supervisor King, seconded by Johnathan Mckee to adjourn the meeting at 7:34 pm.

Ayes: 5 Nays: 0 motion carried


The next Town Board meeting will be July 14, 2022.
